Americans overwhelmingly do NOT want Roe v. Wade overturned

New polling numbers suggest that those Americans vehemently opposed to Roe v. Wade and by extension, abortion, are in the extreme minority.

CNN/USA Today/Gallup poll

"Do you think abortions should be legal under any circumstances, legal only under certain circumstances, or illegal in all circumstances?"

Always legal: 24%; Sometimes legal: 55%; Always illegal: 20%; Unsure: 1%

"If one of the U.S. Supreme Court justices retired, would you want the new Supreme Court justice to be someone who would vote to overturn Roe v. Wade -- the decision that legalized abortion -- or vote to uphold it?"

Vote to overturn: 29%; Vote to uphold: 65%; Unsure: 6%

Furthermore, it shows that President and the Supreme Court only have a mandate to limit abortion via laws like the "partial birth abortion ban" and the "parental notification" type laws, but not a mandate to outlaw abortions completely.

overturning Roe v Wade would simply turn it into being a states' rights issue.

whether or not it belongs there or not is, of course, up for debate.

personally, I'm pro-choice but wouldn't be upset if RvW was overturned.

Even GW said lately, "I'm against abortion, but I may be out of touch" (something like that). They will never over turn R vs W, but they can tack limits to make it very very hard to get one. They can try to control age. Consent (husband and wife must consent to a wife?s decision). The woman?s health (both physical and mental), and current marital status (separated, divorced, single). Some things you might see a GW court do is demand both the father and to-be mother agree to the abortion, in order for the woman to get one. OR, a requirement that the woman's mental health be evaluated, professionally, to make sure she knows what she's doing, and why her decision. A woman may have to travel hundreds of miles to another state to get one, and the courts could make it very attractive for a state to ban, leaving few states that allow it. One swoop wont over turn R vs W, but picking away at the law will make it much harder.
Now that GW will get to choose one, and maybe as many as three, Supreme Court judges soon, I can only imagine whats going through Karl Rove's mind right now. They'll get what they want.

Deal Monkey

Talk about twisting a poll to suit your POV!

Only 20 percent want it always legal...what's your point?? The majority of Americans want to get it either on the books or off the table. A whopping 55 percent want abortion restrictions in place.

Those numbers are a little whacky. Most polls I've seen have it in the low 40's, not 20%. Not a majority, but not 20%.

about how many states would allow it if roe was overturned?

I've heard estimates that abortion would be criminalized in 19-35 states. Many states still have anti-abortion laws on the books that would have the effect of making abortion illegal immediately upon the Supreme Court's acting to overturn Roe v. Wade. Not surprisingly, the states that would keep abortion legal are uniformly blue states - it seems predictable to me that unregulated "back-alley" abortions would become the norm in the states that criminalized abortion.

It is an issue that should be a State ballot issue. This is how the rest of the civilized world deals with it, and it is nowhere near the issue that it is here. Problem here is that we put the decision in the hands of unelected officials. Technically to make a ruling on an issue like this is simply them legislating. Sorry, we elect legislators.

If people get a vote and it is yes or no, there is less complaining about the outcome, because everyone had a chance to have a say. Just works better. They did this in England, and it is not even close to the type of issue that it is here.

Thanks for the post and yes, I agree, criminalizing abortions isn't going to stop abortions from occurring.

If they overturn it, and it becomes a states rights then there are going to be alot more trips to California or New York or wherever (or Juarez, Mexico) by pregnent women.

Well, if you're going to committ legal murder, you should at least have to put a LITTLE effort into it, don't you think?

Yes, let's make people drive around the country to seek out various medical procedures, make the laws as confusing as possible so people aren't sure what's allowed where, and criminalize whatever makes us slightly uncomfortable.

I was just stating what'd happen. I don't think it should be illegal myself, as there is no way to stop it. in the first place. Kind of like pot, you can't stop it, and very large groups participate in it's use, so why is it illegal?

Yeah, I'm sure the Germans living along the roads to Auschwitz were slightly uncomfortable too, but what was going on there was legal too in Germany at the time.

We have our mandatory holocaust reference! Congratualtions, you have now lost some credibility while understating the horror of nazi germany!

I agree. If its turned into a States Rights issue then the bible belt conservatives states will screw the woman in there own state and force them to go to more liberal states to perform abortions.

I like states rights too... but some things are considered so fundamental to be federal / American issues. Having control over your body seems like it fits the bill of an American issue.

Big deal. So the white trash Cristians girls would get back alley abortions. Self imposed Darwinism.

So you shouldn't have control over somebody else's body then? Looks like we agree!

Yep, once the holocaust references start is about the time I quit the discussion, as it has then officially passed any sense of logical debate.
