If they could so easily just haul a guy away by saying "PATRIOT ACT?!?!" why didn't they do it already? Why bother with a GPS if they thought he was dangerous?

I said not AFTER they invoked the Patriot Act.

You quoted that.

No, you said WHEN, not after.

So let me dumb it down for you.

1) Some agency decides to track you...they place a GPS on your car
2) you find it..."OH NOES, I JUST THROW IT AWAY!" muahahaha FUUUUUUU
3) Some agency doesn't like that you defyed their attempt to track you. Declare you a terrorist (which they are halfway there since they had some reason to track you).
4) Now you, your car, and the device are their property.

And I am sure you have a number of links to back you up.

I think problem is that I am arguing about the law regarding ownership of the device and you are arguing about fantasy and conspiracy. What the law says is not in dispute. Your guess as to what the government would do in such a situation is open to debate.

So that's the easy to follow guide. And no, despite the stories told...no one is going to just leave such a device attached, no one is going to just remove it and ignore the fact that it was there, and in the end the device itself is really not the big picture of what's going on.

You are now arguing like a child trying to tell his mommy the sky is really green and the grass blue and thinks he is right because he got all his friends to agree.

Spoken like a boy with experience with such things.

stick your head in the sand, not like I give a shit.

As an "attorney" you should know about the open cases and people crying out that loved ones are victims of this.

Please read the law behind the Patriot Act, it's pretty clear cut.

Again, I am an attorney, not an "attorney".

And, once again, you bring up the Patriot Act, yet you completely fail to point to anything specific in the Patriot Act that would back you up in the slightest.

I learned this little saying in law school:

"When the facts are on your side, pound the facts;
When the law is on your side, pound the law;
When neither are on your side, pound the podium."

You need to give your podium a rest.

Thing is I am not trying to prove anything and even if I copy and pasted the entire piece, you'd just cry and say "it's not real".

Anyway what kind of "law" are you in you seem unlike any other attorney in wanting to give advice in any aspect of law.

Yet you still fail to bring any facts to the table.

So do you, difference is, you are't any kind of a attorney.

so serve it up chief, what kind of law are you currently involved in? Trial work?

I have attorneys here doing clerical work.

Again though I am not trying to prove anything. You can doubt all you want.

Most couldn't even tell you exactly who was arrested last night in their own home towns from just internet searches...there isn't much I can do to help you guys out.

It's sad because this is the way everyone get duped.

dude, butt out; sorry if I hurt your feelings in some way.

Doesn't change the fact that this event happened nor that the Patriot Act exists.

What are you trying to accomplish if I may ask, just racking post count or ePeen points?

Just pointing out how irrelevant to the original argument your posts have become.

Can you please point me to where in the patriot act it allows tracking devices?

I am a litigation attorney. Most of my current work is in real estate, but I have also handled Civil Rights matters.

What are your qualifications to interpret the Patriot Act?

That is a good position to have what you can't prove anything.

We get duped because we cannot show something happened that we do not know happened? If you cannot show it has happened, how can you be so sure it has (or can) happen/ed?

Dude's seriously...it doesn't even have to be in the Patriot Act. It's sad how little you know about your real rights.

Fuck it made national news recently that a judge named Alex Kozinski of the 9th Circuit Court allowed just that. You can read up on US v. Pineda-Moreno.

However; yeah, yet again I am just full of shit because you are all pea-brains and think because you don't believe it...it's not true.

Let me know what you find.

lol a real estate attorney...that's rich. Jumping on the bandwagon for profit. nice.

Anyway I posted a case. You did learn case law right? You should be providing these tidbits, but obviously you don't know shit about what you are talking about.

US v. Pineda-Moreno.

Get back to us on how this shit never happens.

Dude's seriously...it doesn't even have to be in the Patriot Act.

But YOU are the one that said "Not when they invoke the Patriot Act". THAT is what this whole discussion has been about!

Are you backing away from that statement?

sigh...here is the deal...within the Patriot Act this same stuff can be allowed.

However; they don't even need to go there because this is low-hanging fruit.

GPS can be easily planted and when found you are basically told to go pound sand.

This is my last post. It's clear none of you understand the law and your rights and just want to believe in something out of fear.

I am not sure what you mean by that? It is not like I gave up the other parts of my practice and devoted my life to real estate. Whatever walks in the door.

Did I say it never happens? YOU said we would never be able to find that it happens in our own town (or something like that).

I will pull up that case and get back to you.

Go pound sand? I thought you would disapear? Or get prosecuted? crickets?

What exactly, are you saying will happen if someone finds a device?

Keep in mind there is actually a recorded instance of this scenario happening (it's what this thread is about) and nothing even close to what you suggested happened.

OK, Pineda-Moreno:

GPS tracking without a warrant OK? - Found.
Repercussions for disposing of unknown device attached to car? - Not found.

I am not sure what you are arguing anymore. I am not sure you know, either.
