So how exactly do you know he's getting sued? Did he get served with court documents of a claim against him? Is she suing the store? ... or is she just threatening to sue? Either way, she has no case based on the description you provided.

I agree with the above, however; regardless if the ipod was repairable; Best Buy #1 should be liable for not disclosing that. Had they stated they weren't sure or that the customer should seek more professional help that would be sufficient.

i'll agree that generalizations are bad, but this type of thign is extremely common. pretty much everyone wants to make a quick and easy buck.

I worked in reatail for over 15 years. I've been threatened with being sued so many times...

One guy who was waiting to have his TV repaired (we were waiting for a part that was on back order) went over the line. Told me he was going to own my house... sue me into the stone age... blah blah blah...

I looked at him and said, "Ok, our conversation is over. I can not comment on pending litigation and as your repair is at the heart of the pending litigation I can no longer discuss this situation with you. You are free to pick up your TV at any time. Should you wish to pursue anything further in regards to repairing your TV please have your lawyer contact my company's lawyer and they will work out the details."

He left. Two hours later I received a phone call from him apologizing for being an ass.

It's always the same face. Stunned silence. Mouth half open.

"You have no right to talk to/treat me like this" or just shrugging your shoulders and turning your back on them are the fastest ways to shut an a-hole up. They are so used to being able to bully the guy behind the counter and having their ass kissed by the manager that they have no idea what to do when the other guy wont just stand there and take it. Pretty much like any other bully, when you stand up for yourself they back down.

And usually in that awkward moment of slience they realize how they look to everyone around them and become embarrassed and apologetic. Then things move forward and problems get solved.

I can understand people getting upset when their expectations aren't met, but that doesn't give anyone the right to treat another person like a piece of crap.

What does it mean to die for one's country anyway? I find it hard to imagine a scenario where either I die or my country is destroyed.

Maybe not by yourself, but as a group of the members of the military. No one soldier could have made D-Day successful - it was a group effort.

As for the topic of this thread, the problem with all these crazy lawsuits is not necessarily the people bringing the lawsuits, it is the plaintiffs' attorneys who take the cases and file the lawsuits. Most plaintiffs' attorneys seem to take whatever comes in the door and show no restraint or professional pride. Without those attorneys, most of these stupid claims would die on the vine.

Like MotionMan said...however your thoughts are the *new* way of looking at a community/society. Many want the benefits without the efforts to maintain them.

However; that said I believe most of the wars today, yesterday and tomorrow are about someone pushing to profit rather than make things better.

Blame stupid people, not America.

I have a friend who works in a law office. She tells me all the stupid things people do:

1) Mom tries to sue Target because there was a boxcutter in the cart where her baby was.
2) Woman wants to sue city because she drove without headlights(!!!) and almost crashed into a dumpster that was out in the street. She blames the city for not making sure that dumpsters are not in the dumpster is not in the street, and that there should be a street light there. Hello... headlights?
