Am I being scammed on eBay?

I sold an unlocked iPhone 4S to some guy in Sri Lanka. I shipped it 3 weeks ago and he claimed that he haven't receive the phone yet.

I have the tracking on the USPS web site and it doesn't provide any info after the day I shipped it.

Am I being scammed because their post office in India doesn't update shipping statuses to USPS? As far as I know, he may have already received the phone but is trying to say that he haven't.

Ebay Rule #2: If breaking Ebay Rule #1, GET DELIVERY CONFIRMATION.

Consider this lesson learned. Never ship First-Class Mail International. He can dispute with PayPal/Ebay and will get his money back.

If shipping outside the US, only ship Priority or Express. And insurance is always a good idea.

But I have record and receipts, does that provide any protection?

Paypal basically sides with the buyer even if the evidence indicates otherwise.

I had a similar situation with something I sold on eBay within the US. I shipped the item via UPS with confirmation. The buyer gave me positive feedback on eBay once he received the item. A few weeks later, he filed a dispute with Paypal saying he never got the item. I disputed, using the UPS delivery confirmation as evidence. He claimed he got a box but it was empty. I came back with the fact that the weight of the box matched the weight of the item I sold. He claimed the box contained newspapers and not the item he ordered. He got refunded $300. I got screwed.

Record and receipts of your transaction at the Post Office? That doesn't do anything. PayPal/Ebay only concern is whether there is any record that the buyer received the item. First-Class Mail International doesn't provide any reliable tracking. If you didn't buy insurance, that means no protection.

Because fucking eBay doesn't prevent shitbags from 3rd world country from bidding. Even though in the auction it said i only ship in the US.

I found out after the fact that You have to manually go into ebay settings and ban people not in the US from bidding.

And oh, I just found out you cannot close your paypal account. I've tried it so many times and keep getting the same message...

A little googling and it seems everyone is having the same problem, you cannot close your paypal account even though they gave you the option under account settings.

I am going to permanently close my eBay and block off paypal. I'm done getting screwed over by these assholes.

Don't leave with a negative balance if that's what you intend as that can result in collection agencies / credit score damage if you gave them enough information.

Well I've had domestic Priority Mail take about 3 weeks to get delivered. You never know with USPS.

He have an account since 2008 with 125 positive feedback. His buying history includes $1500 laptop from a seller in canada...

As soon as I found out he's from Sri Lanka, I filed for a case cancellation. He clicked refused and told me he really wanted to buy the phone and will pay whatever the shipping amount to ship from NJ to Sri Lanka and suggested i use usps first class international.

Should have sent it registered if available. I sure as hell would for an overseas shipment.

Years ago I was looking for a clear case for a cell phone (Sanyo's first camera phone). A company in Malaysia was willing to make it and sell if but they needed a phone to use as a template. So I bought a dummy phone from ebay and sent it to them (they paid me first). Interesting thing was they said I should send it registered mail. I guess they must have issues with packages being delivered.

Unfortunately for you, a very expensive lesson learned.

I haven't used ebay in many years, but when I did, I could always set up my auction to only allow bidders from the US bid.

Is that option gone or something?

Umm, for every auction that you list, you choose whether you're willing to ship internationally or not. You glazed over it, apparently.

Sorry for your dilemma though. Dealing with eBay/Paypal as a seller can be a nightmare.

I remember once I was in a place like that.... it was Sri Lanka, formerly Ceylon, at about 3 o'clock in the morning, looking for one thousand brown M&Ms to fill a brandy glass, or Ozzy wouldn't go on stage that night. So, Jeff Beck pops his head 'round the door, and mentions there's a little sweets shop on the edge of town. So - we go. And - it's closed. So there's me, and Keith Moon, and David Crosby, breaking into that little sweets shop, eh. Well, instead of a guard dog, they've got this bloody great big Bengal tiger. I managed to take out the tiger with a can of mace, but the shopkeeper and his son... that's a different story altogether. I had to beat them to death with their own shoes. Nasty business, really, but sure enough I got the M&Ms, and Ozzy went on stage and did a great show.
