last i heard XP OEM licences are only valid for the first motherboard there used on. moving the license to another motherboard is a violation of the EULA.
 
I sold Windows ME OEM back in like 2001 with a 16KB FPM Ram module from an 80286. The Microsoft police never came after me. I swear someone actually bought it, even though it was Windows ME.
 
Forget it man. eBay and Vero will crack down on you. They will suspend your account or even disable it permanently for repeat offenses. I speak from experience - negative experience. If your account is important to you, then dont.

I would imagine that licensing terms have changed since ME, so what may have been kosher then is not now. To answer the OP's question - legally you can't sell it if it has ever been installed. Likewise, if it is an OEM from a manufacturer like Dell, you can't sell it. If you purchased it from someplace like NewEgg and have never installed it, it technically hasn't been tied to any specific hardware so you would be in a grey area, but that wouldn't necessarily mean that your auction wouldn't get nuked.
