Have you noticed that almost everywhere you call now has some kind of announcement about that? Isn't it time to change the laws to permit recording of all calls without such an announcement? Isn't that 'expectation of privacy' long gone?

The reason it is presented to the caller is so implicit consent is granted by you, the caller, to whatever company is recording the call.

Thus, you cannot activate the statutory or common law aspects of legal system with a complaint that you were illegally recorded and thus some privacy statute or common law protection was violated. .

My little podunkville clinic that nevee has more than 4 people on staff at one time put one of those blasted announcements on. You call, you get the schpiel even before the internal phones ring for them to answer. And they don't record squat, just play the nonsense.

It’s for customer service rating/scoring stuff. They want to ensure person talking to you is actually doing their job or simply to be assholes to the person on the phone by micro managing them.

Common law is built up through case history...you gotta victimize yourself first and hope your case has enough substance to overturn precedent(and the intended morality behind it) after appealing to the highest court in the state/federal level. (Hint: probably won't happen). It also doesn't get taught because people are pieces of shit and having that knowledge taught is basically giving weaponry to those who will abuse it; but that also means the likes of those who need it won't use it either(such as immigrants who don't know English and thus are prey to lawyers who speak their language)

Statute-wise, having a law that presumes consent is granted would open a can of worms that would stop such a law in its tracks.

Expectation of privacy as a legal concept is basically that if you're in a private place, you have it. If people can't hear you talking in the room you are in, then folks on the other end of a call from that room can't record you either.

Some states already have statutes that do the complete opposite, where all parties must give consent.

One party consent and two party consent need to go away in favor of implied consent. You need to expect to be recorded when dealing with the public.

Everyone already knows what I look like quite well enough and NOBODY wants to see it in further detail.... I don't worry much about being "spied" on because I'd say it's FAR more likely I'd get paid NOT to show pics!

Does anyone really think any of these compares give a crap about your interaction with that company? Does anyone really believe anyone will ever listen to that recording? Or.... if you had an issue later, the recording could be found or located by that company?

It's like those sales-receipt questionnaires. If you give the company five stars or one star, do you think anyone at that company really cares. You really think that company will "improve" whatever service they provide based on YOUR rating?

This idea of "caring about what people think" gets me to no end. And especially lately in the medical industry. Whenever you need to see a doctor, the office will now have people fill out one of those forms asking shit like.... DO YOU FEEL SAFE AT HOME, or DO YOU HAVE ISSUES WITH DEPRESSION, or DO YOU FEEL YOU NEED HELP OR ASSISTANCE IN THE HOME?

I know.... I know.... the need even to ask for that information is only some brain-storm BS from some government agency guy sitting at desk.

Why do i know this?
BECAUSE NO ONE REALLY CARES! NO ONE REALLY GIVES A SHIT if you "feel the need for home help" or "feel that you are in danger in the home", or "feel safe in your home" or "feel depressed".
They don't care.
They only ask you those BS questions because they are required to ask those BS questions. And no one plans to do anything about the answers if you are depressed or in danger or need in-home assistance.

Why the rant?
Because I have encountered this more than ever with my sister who is dealing with cancer. Pancreatic cancer. The worst of the worst cancer. And at every doctors appointment my sister fills out one of those BS forms or is asked by a nurse the questions. And every time my sister answers YES, I NEED HELP IN-HOME and YES, I FEEL DEPRESSED or YES, I DO NOT FEEL SAFE IN MY HOME because he is so very weak and so very frail. And yet.... all the BS questions and all the BS phony baloney concerns from the staff always end with NO HELP, NO FOLLOW-UP, and NO CARING AT ALL.

Every time the response my sister gets from the assistance organizations is... SORRY, WE JUST DO NOT HAVE THE STAFF TO HELP YOU.
"You can not get in-home help", "you can not see a shrink about your depression", "you can not have your environment evaluated to make it more safe and secure".

And THIS is why I always ask... WHY THE F EVEN ASK THE QUESTIONS IN THE FIRST PLACE? NOTHING IS GOING TO BE DONE. SO WHY EVEN ASK? WHY PRETEND TO EVEN CARE?

Like I said, I now know why.... simply to satisfy some BS government requirement that means nothing and goes nowhere, yet somewhere in some government office some government agency guy feels SATISFIED that you were even asked those BS questions knowing damn well the entire process is pointless. Entirely BS pointless.

God help us all..... We need it.

Imagine being labeled a pedophile because of what should have been a private image between you and your doctor.

Technically, rights are laws. But many rights are not "free" in terms cost of time and money. Bare minimum, you're going to hole up and take a day off or two to use a law library.

Common law requires a filing fee(unless indigent) and knowledge of all the rules of evidence of the higher court that has jurisdiction over it. Basically, all non-lawyers might as well stop here for many acts that are not worth the time and money to file a case. Thus, there is a de facto state of anarchy in society for "small" violations. If someone enters an unfenced area property without consent but does nothing to it, that is still common law trespass. But is it worth filing a lawsuit? Probably not.

For that "auto detect", the person you mention might have a basis for a suit of something like defamation, but because it is a machine "snitching" and not a human, there is no real case history and oftentimes judges don't want to stop law enforcement. In short, it's very YMMV.

I think the depression question is basically to screen for someone suicidal. And if not, well, they won't do anything.
It's all to avoid tort liability in the end though. The law will excuse "can't help due to lack of resources". The doc and other orgs avoid the charge of "didn't help and negligently caused harm" by doing things this way.

Speaking as someone with professional experience, it may not be universal, but I've absolutely worked with companies that do monitor those recordings and retain them for a specific period of time.
