Full refund, what are we talking about here ?? Was he gonna charge the 15% restocking fee or just the shipping charge ??
If its just the shipping charge, just chalk it down as a lesson learn.
You should know by now to do your research when buying from the internet.

No, you aren't being an ass. The phone is pictured on their site with no branding, and I would expect to receive a comparable product to what is pictured. If it said that the product could differ substantially and possibly have foreign markings, then they have a point.

On another note, that company sucks horribly! At a bare minimum, you're paying $120, but in all likelihood you're paying $180 based on the their completely subjective "used" definition in the terms. 20% restocking fee should be illegal, and what's the restocking fee if the manufacturer is shipping direct? Plus, I LOVE the "RMA is valid for 5 days, and return product must be received within that time period". WTF? You almost have to use Next Day or Two Day to guarantee delivery in time.

I'd go through AMEX and also contact the New York Attorney General and/or BBB. That outfit is fishy.

Thanks for the reply Andrew. Yes, that is indeed weird that they charge you a restocking fee when they claim they ship straight from manufacturer (which I don`t believe they do). Thanks though, I`ll wait for them to ship me a brand new, never opened Nokia 6630 on Monday and if they fail to do so, then I`ll dispute it.

Give them the chance to make it right by sending you the real think (undamaged and unused). If they fail to do that, send your credit card company a letter disputing the charges, explain that you received used/damaged merchandise and that the seller has not followed through on promises to send a new one. Then, contact your state AG office, and certainly file a complaint with the BBB. Finally, make sure you put a review on resellerratings so others can avoid that merchant.

All that is, of course, if they fail to come through. If they get you what they promised, you can leave it be....
