Advice needed with Credit Card Dispute

So I purchased a Nokia 6630 cell phone from http://www.wirelessimports.com and received it yesterday. When I opened the UPS box, the Nokia box was in really bad shape (corners damaged and clearly the box was opened multiple times probably to show off to potential customers in ITALY). Anyways, here`s why I say Italy: the phone has frickin Italian Carrier`s stickers on it and everything is in Italian including the User Manuals. So I sent them an email asking them to give me a RMA # and Return Adress so I can send it back and I want a full refund including shipping as this is not what was advertised on the website. I expected a factory sealed brand new phone intended for an English speaking dummy like me as I did not even check wirelessimports.com on Resellerratings.com (they are not on there).

Anyways, if they refuse to refund me the entire charge, should I dispute it with the CC company? What will happen next (after I dispute it)?

there is no downside to writing a letter to your CC company disputing it. not that you'll necessarily get the charges reversed, but all it costs you is 5 minutes to write the letter and a stamp.

give them a week to fix it, then write the letter to your CC

Just got a reply from them, a very fast one. I`m thinking this is a one person company, no real company replies this quick :p Anyways, here`s what he says:

When we shipped you your handset we shipped a brand new handset, if it was damaged at all it was from shipping, not us. Since the Nokia 6630 is a WCDMA / UTMS handset it requires a very fast network to work with to allow it to take advantage of the video calling which it is capable of. This is the reason the phone is branded with a Italian carrier. There is no such thing as a nokia original 6630, all of them are branded by one carrier or another. In regards to the user manuals we can work on getting you an English one if one exists. When you had placed your order there was a check box you had to click on in order to proceed with the transaction. It stated that you had read our return policy and is in complete agreement. If you had briefly skimmed it or not read it at all it is not our responsibility. All customers are responsible for their own, if orders are placed over the phone we are sure to make aware of our return policy verbally.
You can call us at anytime to get a return RMA # as well as a return address.

and I replied with this:

I checked that box and accepted your policy believing that I was receiving a brand new phone with English Manuals and no Italian labeling. Clearly what you advertised is not what I got, putting the purchase agreement on a dead end. I just want to make sure that we are clear about the fact that I want a full refund for false advertising. If you disagree with this, I`ll prefer to solve this issue through my CC company.

i don't think you're being an a$$. if you didn't get what you paid for, you should get a full refund. plus shipping.

That`s the problem, I know I`m gonna get pissed off and hangup if I call and get a negative answer. Then I`ll call AMEX and just go through with them. I don`t want to get pissed off. I want to give him a chance :p

get someone else to call for you. you agreed to the terms, so you have to try and return it. your CC won't give you a free pass if you don't try to work it out

or just re-sell it on ebay

with AMEX, it'll be easy to dispute the charge

You will have to wait until your statement ends before you can dispute

What carrier would use that and how would you get it to work?

Nowhere does the listing state that you are getting an unbranded phone with English documentation, in fact if I was ordering from a place called wirelessimports, I don't think I would be in the least surprised if the phone did not come with English documentation or had stickers on it from a carrier in another country. Carriers rebadge their phones all the time.

And, how do you know the box was not opened for customs inspections? You seem so sure that it was a display model...are there signs of use?

The bottom line is this: Does it work?

Because if it does, Nokia makes all of it's manuals online; you can get an English 6630 manual right here. It seems like you're making a big fuss over something small.

Well, nowhere does it say it will be branded either. The purchase agreement also states that it comes with full manufacturer warranty but the box I received doesnt even have a warranty certificate. And when I pay $599 for a phone, I want it to come with paper manuals, I don`t want to go online searching for manuals. And I`m pretty sure it was a display model because I`m not worried about the fact that the box was opened once before but it was opened a good amount of times. It has wear and tear that you wouldnt expect from shipping, it`s clearly due to usage.

Well, one interesting thing is that their website states that all phones are shipped as packed "directly from the manufacterer".(in the faq section)

If this is true, the box should have been shrinkwraped. Would customs have removed the shrinkwrap and taken out the phone to look at what is inside? I doubt it, an xray scan is more likely.

I'm betting you didn't recieve a new phone, probably a return/refurbish/floor model.

I don't remember ever getting a warranty certificate for a phone. I've had 3-4 Nokias. I don't even remember them coming with one of those silly mail-in postcards. Maybe you did get a warranty certificate, but you didn't realize it because it's written in Italian?

Well...tough crap! I mean honestly...lots of phones come with scant documentation these days. My last Nokia purchase certainly didn't come with the 80-page manual that I found on Nokia's site. Besides, you did say that it came with paper manuals, just that they were written in Italian. You bought an imported phone, you got imported documentation. Seems unreasonable to buy a phone sold in a non-English-speaking market and then act surprised when you get non-English docs.

Well, I can't outright contest this statement seeing as there's no way I can see the box, but based on your other complaints, I'm sceptical at best.
I've seen some surprising wear on boxes from shipping.
Also, not everyone shrink wraps their merchandise.

I was thinking the exact same thing. It sounds like assuming bit you in the @$$. If you had any doubts or questions you should have asked before purchasing the phone. I also can't see why someone would want to pay that kind of cash for a phone. But that's just me.

I just got off the phone with them. I`m pretty sure this is an apartment-run business in NYC. Anyways, they promised me that they`ll ship me a brand new OEM Nokia 6630 on Tuesday (they`re getting them on Monday) but they want me to ship this one back today. What ticked me off is that i asked him if they could send me an email stating that they will ship me a brand new 6630 next week and i`ll be shipping this one back when i get it, he said "there`s no need for that, you can just dispute it if you don`t get what you want". What should I do?

well if they dont send you and email i say return the phone but through FedEX/UPS with signature delivery.
then file a CC dispute late next week after they had shipped you a "new" phone.

if they dont want to have any documentation too bad for them but all the better for you :D

It has the stickers from whichever shop it was bought from in Italy, trust me, I showed it to my friend who has been to Italy and it gives the price including tax on it and says "Exclusively for TIM Stores" on it. Why are you trying to prove me wrong? And you are wrong about Nokia Phones, all Nokia Phones come with a warranty card and has IMEI sticker on the box. This one`s IMEI sticker is broken.

A lot of people purchase imported phones because that is the only source of some of the cooler phones. It's not unreasonable to expect that the phone comes in its original packaging and undamaged. It is not stated anywhere that the phone might be damaged. I am fairly certain that if an item is not brand new it must be explicitly stated that it is not.

It sounds like you should just wait and see. The operator was right... you have a verbal agreement with them and that is enough to dispute the charges if they do not do as they say.
