Advice needed: gf smashed garage door

My gf smashed my garage door in a stupid car accident a few days ago. The brick wall on the left side of the door was damaged as a result. I talked to the property manager of my condo association. She didn't want to pay for it. I pay $185/mo association fee and I was told that condo association covers repair and maintanance of outside areas. And this brick wall is clearly an outside area (it's shared with other units).

In this case, should the condo association pay for it? Thanks!

Why the hell should they pay for it? Your GF and/or her insurance company should pay for it. That's like asking Walmart to pay for repairs to your car because a shopping cart bashed into it in their parking lot. :roll:

It's called being responsible for your own actions.

Not for repairs for damage you cause...

Those fees are for general maintenance and repairs of the grounds. Driving a car into the side of a building doesn't fall under the category of general maintenance/repairs.

Your association fee isn't a form of insurance to cover the stupid sh!t your girlfriend does. It's for regular maintenance items, like lawn care, fixing the shingles that were torn off of the roof in the last storm, garbage collection, etc.

No, I haven't, but it doesn't change anything. As mentioned, that $185 covers general maintenance and repair, not what happened when your drunk GF drove a dump truck into the wall.

My dad sits on the board at a condo community. When somebody causes damage to the property, they go after the person who caused the damage.....in this case, they'd be going after you, and they'd probably put an encumbrance on your deed if you didn't pay up.

They don't tap into the association's treasury which is supposed to be used for general maintenance, insurance and acts of nature.

Read the HOA contract you signed when you bought the house. It will have a section about liability. I can almost guarantee that you are liable for the damages to the property.

Contact your insurance carrier.

 
this guy is clearly in the right. clearly the wall needs repaired, and clearly the wall is outside. i don't know why this is so hard for some of you to get your heads around.
