Ok first of all my primary DC is 2003 R2 box, I recently added a 2008 R2 server that I'm wanting to act as a backup to the old DC.

So Far I have done.
-adprep32 /forestprep
-adprep32 /domainprep
-adprep32 /rodcprep
-changed the domain to native from mixed mode
-Raised forest function level to 2003 from 2000

And now the Problem is, this message ---
A domain controller running Windows Server 2008 or Windows Server 2008 R2 could not be located in this domain. To install a read-only domain controller, the domain must have a domain controller running Windows Server 2008 or Windows Server 2008 R2.

The forest functional level is Windows 2000. To install a read-only domain controller, the forest functional level must be Windows Server 2003 or higher.

Can I not use the new box as a secondary on a 2003 network? And does the 2003 server need to be restarted before the FFL is raised?

You can't use it as a RODC. At least one Win 2k8 or 2k8 R2 DC is needed for a read only domain controller to work. Do you need the functionality of a RODC? If not, you should be able to add it in as a normal DC to be used as a "secondary."

Don't check the "rodc" box. Otherwise the process is identical barring the "RODC Passwords" groups which you don't need.
