Actress sues Amazon for revealing age on film database

"A US actress has lodged a $1 million lawsuit against Amazon accusing the Internet giant of revealing her age on the film industry website IMDB by using personal details from her credit card.

The actress, who asked for her identity to be masked and is referred to only as "Jane Doe," has launched the suit for damages and interests with the Western District Court of Washington state, in northwestern Seattle.

She is alleging fraud, breach of contract and violation of her private life, as well as her consumer rights.

According to the suit, the actress, who is of Asian descent, changed her name to make it more American and has never wanted to reveal her age in order to maximize her chances of obtaining film roles.

Since 2003 her profile has been available on the Internet Movie Database (IMDB), which is owned by Amazon, when she joined the site as an unknown actress.

In 2008 to increase her exposure, she subscribed to IMDbPro which offers "insider information" to paying clients. To join the service, the actress had to hand over her credit card details.

"Shortly after subscribing to IMDbPro, plaintiff noticed that her legal date of birth had been added to her public acting profile in the Internet Movie Database, revealing to the public that plaintiff is many years older than she looks," the lawsuit states."

Seriously? She played a teenager in a movie 16 years ago... I'm not great at math, but even I know that she'd have to be in at least her early 30s by now. Is she trying to pull off 20?

For some reason I thought your birth date was a matter of public record anyway. I think I had to request a copy of my birth certificate for my passport last year and I got that impression.

Technically it was IMDB, which, while it is owned by Amazon, is not really connected to Amazon.com. IMDB posts every actor's age if they can get the information (which they generally can). How does she know that they got her birthday info from her credit card? What if they found it from some other source?

Amazon owns IMDB.

She signed up for IMDBpro, which requires a credit card and for you to fill out a profile. They did NOT get her DOB from her using her credit card. Their payment form does not require DOB. She is linking the payment processing and then creation of an account profile together which is bogus and also means she fails at using the internet.

Also if she had read the terms of agreement and their privacy policy, it clearly says they will USE any information you give them to improve their site(among other things). You have to sign up with a credit card. It asks for name address, etc, but not DOB. You then have to fill out a profile. They may have gotten the information from her account profile. Which she may have thought was private, but again, any information you give them, they can use per terms of agreement.

I'd like to know what evidence they have of them getting her DOB from her profile. I am sure they have zero evidence of such. I am sure they are hoping to find during discovery. But based on the terms of agreement, she has no case and her complaint should be dismissed on summary judgement.

Personal details would be them showing the cc number, not your age and that's not on your cc so clearly it wasn't done like that.
 
I would bet that when she signed up for IMDPpro there's an option to not display your date of birth when she set up the option to add a resume and she neglected to notice it.

No. Must be a 40 yr. old who looks young for their age and couldn't land a job as an upcoming "actress". Looks like she expected too much by "Americanizing" her name too. And what is she doing in Texas, move to California/NY for more exposure.

You're right, there is no DOB on a CC, probably the bank it's tied with has that info. She should also sue the bank for releasing that info to IMDb if they did such inquiry.

Hopefully her identity will be revealed soon.
