A "truth in advertising" question....

If a company advertises a product at a very low clearance price, gets lots of orders and sends the following e-mail out in response...

Due to the extremely competitive nature of our business we are advertising a few items as loss leaders and an item on your order is one of them. We will not be able to process this order.

would that be considered false advertising? Would this be something for the FTC (I know BBB would be interested). I'm not wanting something for free... but I feel that blatantly lowering the price on the site and knowing that you aren't going to honor it just seems dead wrong! :|

Well, if it's a clearance item, I would assume that would mean a limited inventory and once they're out, no more from the manufacturer as it's discontinued.

That's not the way the e-mail is worded to me....it seems that they are saying that we just advertised to get you here...not to see the product? Maybe I'm just reading it wrong? 😕

(P.S. Cats had negative yardage on their first 4 sets.....duh! What did they expect? 😛 DASM CARD FAN)

 
Was this an item that might have been spread around various deal sites and been sucked dry by people looking to profit on eBay?

Sounds to me like other "ferengis" other than yourself got into the deal and they ran out of the item you wanted.
 
It depends on their legal disclaimers. Most companies say that they can cancel any order at any time for any reason. If this is the case, then tough luck.

Yep...I understand that they have a right to cancel...I actually didn't get an order...I was just posting the quote from another person's e-mail. Just seems like false advertising to me....many sites needing increased traffice numbers could post false prices.....get millions of hits......have a search routine to cancel all orders with that particular item and send out an e-mail......(of course, their resellerratings suffer)

Oh well, since I didn't do this...I just wanted other's opinions....

I remember learning about a bait and switch in high school. Stores would advertise an item that they have very few of for very cheap, just to get you into the store. Then, when you see they are out, they have a slightly different item that is more expensive.

This seems like the same type of thing, it's just online.
 
Strange though...they are not out. They simply changed the price and cancelled orders after a few hours. You can order at the higher price if you want. That is "ONE" of the many excuse e-mails that was sent (many with different reasons).
