A Thought About Speed Activated Spoilers

Some cars (the VW Beetle comes to mind) have speed activated spoilers that pop up at 80 MPH but do not go back down until you go much slower or stop.

Are they not an indication that you have, at some time since you started the car, been traveling in excess of 80 MPH?

Could a cop see your raised spoiler and give you a ticket for speeding? It's like an admission of guilt, no?
 
Wouldn't they need quantitative evidence? I mean, the spoiler could be broken or whatever other excuse you'd like to come up with.
 
That'd suck if they used that against you, but they'd have to know what make of car has that and what speed it comes up at, etc.. So I'd think not, but I guess its possible.

They can easily be over ridden, I can see the cop now, but judge, his wing was up, he must have been doing 80 😉

Remember that the police have to prove you were breaking the speed limit, thus they have calirated speedometers, radar equipment and painted lines on the roadway.

How are they over-ridden? And wouldn't it be easy for the cop to see that it was stock?
 
There are usually six wires running to and from these ricer spoilers, one of them is a trigger, ground it out and the wing raises, break the ground and it lowers.

It does not matter even if it was stock, how is he going to prove that you were doing over 80 ?, he cannot, any judge would throw that out of court and reprimand the officer

Say what now??

I don't see how the officer in question could rightfully charge for speeding.. as they have to qualify the excess over the limit...

but, who knows.. I'm sure somewhere, sometime, some speeder is going to get busted for it, and have the charges stick..
 
Porche used to have the spoiler on the Boxter pop up when going 80+ but they changed it in the newer models to 55+ due to their customers getting speeding tickets because of them.

If they don't lead directly to a ticket than can indirectly contribute to getting one as the cop might notice you when he previously would not have.

It would mean they could have been drinking, but doesn't confirm that they definitely were.
