So do you agree with our Vice-President Cheney who claims that he is not part of the Executive Branch?

This is one for the constitutional scholars to debate. If we want to return to the original intent of our founding fathers, then we will have to allow the candidate receiving the most votes in the presidential election to become president. The candidate finishing second would become vice president.

The vice president as head of the senate would provide a legislative check and balance to the executive office of the president.

"The Constitutional scholars" resolved that debate on September 17th 1787, the date the U.S. Constitution was ratified and adopted. The U.S. Constitution explicitly defines the office of Vice President as part of the executive branch:

The executive Power shall be vested in a President of the United States of America. He shall hold his Office during the Term of four Years, and, together with the Vice-President chosen for the same Term, be elected, as follows:

I voted for the first choice, that he is part of the executive branch.

I was thinking that the 12th amendment is flawed and we should think about repealing it. That would put the vice president into a real position of power and help control abuses of the office by the president. Oh, we'd also have to get rid of the electoral college. That was what brought about the 12th amendment in the first place.

I don't see where the Exec Branch portion clearly states that the VP is part of the Exec Branch.

Moreover, the VP is mentioned in the section regarding the Senate.

It looks like the huge amount of laughter and mockery, along with the threat of getting rid of the vice president's funding (that goes through the executive branch's funding) that Cheney's assertion was met with have caused him to largely abandon it here.

True, he hasn't specifically repudiated it... but when you put forth an argument that is almost universally derided and then you say "well let's not argue about that anymore, I have a new reason now. ", that's a pretty clear admission of defeat.

The President and VP will erect any number of phony arguments until a court rules their arguments are baseless. Meanwhile its a pissing contest in front of an apathetic public who thinks both branches are full of sh!t. Welcome to the home of the used to be free and the land of the apathetic.

He is abosultely part of the execuitive branch. His only legislative function is to break ties in the senate. And as Harvey pointed out, when in doubt, just read the frickin' constitution. It's pretty clear on that issue.

It's an interesting argument Cheney is making... But it doesn't hold water.

As I recall Cheney invoked "Executive Privilege" when he wanted to keep his energy task force meetings from the public.
So how can he now say he is not part of the Executive branch?
