A legal question for lawyers

So I financed my car starting October 2001 for a period of 6 months, but I realized that the interest rate was very high so I paid off the car in November 2001, before the financing period even began (I paid no interest). I was trying to sell the car last week and found out that I didn't have the title with me. I contacted my bank and they told me they had my title of ownership for my car and they overnighted it to me.

My question is "are they allowed to keep my car title for 5 years, after being allegedly paid off in November 2001?" Please reply only if you're a lawyer or if you're very sure about what you're saying. Thanks in advance.

So they guarded your title for free for five years. As long as they don't send you a bill, it sounds like a good deal to me. :beer:

Their oversight in not sending the title to you 5 years ago matched your oversight in not asking for it 5 years ago when you paid off the loan. The law recognizes that people can make mistakes and you've not been harmed. They overnighted to you as soon as you asked for it.

You neglected to ask for it when you should have (irresponsible). You later asked for it, and received it, what's the problem?

If you had asked for it & they refused you might have a point, otherwise aside from you forgetting to make sure the title was sent to you shortly after the car was paid for, no one is to blame here ... doesn't take a lawyer to figure this one out!
