A company registered their name as my domain name...

I've had the domain for a while, but haven't had time to make real use of it. Recently I've had more time and noticed that a company registered their name after my domain name. For example, my domain is 'world.com', their company is 'world inc.' and their domain name is 'theworld.com'.

My domain name was from years ago. Their company seems to be only a year old and probably inactive now.

Any issues with me actively using my domain name?

No, they would have to have a preestablished trademark for their to be any issue which could effect you.

What about their company name(it is registered.)? Do I have to wait for that to expire if I want to pick it up? I like my domain name and would like to use it as the company name to go with the domain.

Depends, if they are local or in the same field (e.g. computers) it could be an issue. But such name registrations typically are done at a county level.

I hope it doesn't come to that. I know I came up with the name before them and might have scrap papers with various development notes on it with the name. It's probably 1 person operation and they didn't make much progress and lost interest.

Would kinda suck for a company called World to get a trademark. That would affect quite a lot of companies. Also shows how the system is silly. If you had a full blown established site there but just never had the money to trademark it then someone can do it under you and screw you over.

That's actually a pretty good domain. Simple word domains are quite hard to come by, but shows they're still out there.

I did get a 3 letter .me a while back but that's not as impressive as a good .com.

This is definitely not the case, as quite a few lawsuits about various peoples names have ended with the domain going to the company in question, regardless of the individual having owned it for, in some cases, up to and beyond ten years.

Yeah but if a company called World trademarks their name, you have to give up any domain with that in it, at least that's the way I understand it.

Even if it sounds like it, you have to give it up. Remember mikerowesoft? Was a personal home page and MS forced him (his name was Mike Rowe) to give it to MS.

You have it completely wrong. MS settled with him.

Nissan Motors is suing the pants of Uzi Nissan, the guy who owns Nissan.com for his computer repair business. He refuses to settle.

That Nissan case is still going? I thought he had already been sued and it was the end of it. Guess Nissan thought they were going after some small mom and pop computer repair place, and were wrong. :p

edit: Hmm just checked nissan.com sure enough. I could have sworn that used to go to Nissan's (as in the car company) home page at one point.

Yup, you are right. I was thinking that the too. I hope they win. They had the name first. Nissan shouldn't be allowed to trademark something that already exists just to squash it.
