___ Entry into US denied... Any recourse? ___

Blain

Lifer
My church agreed to hire a part-time worship leader from Costa Rica. He and his wife have visited here to meet the membership and discuss the position.

The church filed the paperwork with the imigration service to request a work visa for the gentleman and his wife. Everything was a GO...
They returned to Costa Rica and sold their home as well as other items they couldn't bring with them.

They arrived at the international airport in Atlanta. Once the officials at the airport learned that they had sold their home, they denied them entry and had them return to Costa Rica.

Needless to say, this news came as a shock to everyone involved. Now they are back in Costa Rica with no home (staying with relatives), and out the cost of the return flight.
Does anyone know if the church or the couple may have any recourse in resolving this issue? 😱

Don't worry; Christianity has ALL the answers for ALL of life's little problems.

The important thing is that they have a place by the Lord's side in the afterlife, correct?

Don't worry about where they are going to live or how they will survive; THE LORD will provide.

yeah sucks doesnt it? the reasoning behind it is now the family has to reason to return to C.R., no assets there, and bottom line no incentive to come back once the visa expires.

anyway like another one said, it doesnt grant residency.

they screwed up big time.

This is true work visas do not guarantee residency. As far as any legal recourse goes it would probably cost considerably more money than the lost.

A good friend of mine was here on a work visa while his wife was in school for 7 years in 1997 their visas were revoked and they had to go back to Chekoslovokia. The fact that thier daughter was born here had no recourse on the situation. They applied for citizenship before leaving and it was not until this past July that they were allowed to return with green cards of course. Oddly thier daughter was considered a citizen upon thier return.

Based on what happened with Milan and his family your Costa Rican friends will get nowhere fast. I know it is a different situation but when they tried to enter the country and informed INS they sold thier house they felt probably felt that these persons had no intentions of going back when the visas expired.

Check out the requirement here for work visas.

Wow, that does sound like a bad situation. 😱
I guess being turned back (to Costa Rica), before they got established is probably better than if they had created strong bonds here.

Flamers:
* Did you feel that because I asked about a matter that happened to involve my church, that I was trying to proselytize you?
* Or is your posting just a knee-jerk reaction to the word "church"?

Not odd at all. AFAIK, pretty much anyone born on U.S. soil or as a child of a U.S. Citizen is given citizenship...(I assume the latter because military brats are all citizens).
