9800pro Shim height

I have read in a lot of places the shim is higher than the core of the 9800pro, some other places where the core is just slightly higher. which is true? i'm using an aftermarket cooler so i'd like to know if i should remove the shim.
My card has a R360core.
 
Can you tell if the cooler is making solid contact with the gpu? (some coolers have a raised surface where the contact would be, to make sure it sits good) I know some 9700p cards had this problem, but I never heard of a 9800p with a bad shim, including the one I used to have.
 
I had 2 9700 PROs.
I put a straight edge across the shim and there was 2 or 3 thousands clearance between the core.

All the 9800 PROs I had the shim was level with the core.
