section 8... one of the worst social policies ever enacted.

A small Connecticut town is being sued for allegedly discriminating against minorities in an effort to keep its black population "so low that it does not register above zero percent," according to a federal complaint.

The town of Winchester "systematically and unlawfully" works to keep out African-American families by denying access to federal housing vouchers known as Section 8, according to a lawsuit brought by the Connecticut Fair Housing Center and plaintiff Crystal Carter.

"We are challenging a pattern of denying minorities fair access to housing," said Greg Kirschner, staff attorney for the Connecticut Fair Housing Center .

Carter, a single mom of six children, joined the lawsuit after she was allegedly told by the Winchester Housing Authority (WHA) that she was ineligible to apply for Section 8 housing in the town because she was not already a resident.

The WHA also told Carter "that Winchester was not on a 'bus line,' there were no real jobs there, and it was in the 'woods,'" Courthouse News Service reported.

According to census data, 94.4 percent of Winchester's 11,000 residents are white and 4.5 percent are Hispanic. The number of African-American residents is “statistically zero,” according to the complaint.

The lawsuit claims the WHA is keeping minorities out by enforcing a "residency requirement" for those wishing to apply for Section 8 vouchers in its 17 communities.

Kirschner says the practice violates Section 8 guidelines.

"These requirements are unlawful because in communities with populations that are disproportionately white and or/non-Hispanic they perpetuate segregation by excluding minority applicants who live outside those communities from obtaining housing here," the lawsuit states.

Officials at the WHA could not be reached for comment. The agency's website said its mission is to "provide, without any type of discrimination; decent, safe, affordable housing and a sustainable living environment."

The Connecticut Fair Housing Center filed the lawsuit last week and is seeking both a policy change and punitive damages.

Not all black people are on Section 8. Dumb reason to sue, if you want to be poor...move to a Section 8 town. Nobody wants freeloaders in nice neighborhoods.

This town needs to stick to its guns. If they want to see how awesome Section 8 it for towns, they can come here where I live and see what it did. From blue collar nice middle class town to rapidly becoming a shit hole. I give this place maybe 10-15 years. Will be just like Robbins, Harvey, etc. Hell, parts/blocks of it are already like that.

I've seen section 8 ruin neighborhoods. If a city has a high need for section 8 housing I can see it but I have never agreed with expansion into the cities that benefit zero from the influx.

That's how Daley tried to get Chicago to be "nice" again. Got rid of all the Section 8 and public projects. That those upstanding people and their even more upstanding kids had to go somewhere was not Chicago's problem at all. Towns like mine got the bribe, the Section 8, and now are stuck with all the problems. The hipster kids can go hang out in the used to be shitholes though and act like they're living tough, and people can pay $300k for a condo.

Mission Accomplished.

I thought the " Northern States " were all liberal and progressive. If this was in a southern state instead of Connecticut the same posters above would be screaming bloody murder about all the bigots and red necks etc...

New England is every bit as racist as the South, it just doesn't come to the surface as often since there are so few black people. There were plenty of the few blacks living there lynched in the New York draft riots of the Civil War, though.

Let's not get into a tizzy before "getting sued" becomes "was successfully sued." You can sue people for any reason you feel like. Whether it goes somewhere is entirely another thing.

Strict neighborhood association board rules seem to work quite well in our town. Our rules include being ejected from the neighborhood for non-compliance.

City can prevent section 8 altogether. However, if you allow whites old farts to have section 8, you can't just openly discriminate against blacks. And its more than just a single town involved. The 17 communities involved cover about ~1/10 of the square mileage of Connecticut. The Housing Authority is likely going to get a smack down in court and an even worse smack down by HUD.

Also not all section 8 housing is ghetto.

They are preventing people that do not already live there from moving there to live in section 8 housing. Unless you can show that they have allowed whites that did not live there to move into section 8 housing than the whole race angle is just bullshit.

That is what discovery is for.


Residency preferences. A residency preference provides applicants who
live in a specific geographic area at the time of application a priority over
nonresidents.

a. Owners must never adopt a residency requirement (meaning the
owner will not lease to any applicant who does not live in the
defined jurisdiction or municipality).

b. A residency preference may not be used for the purpose or effect
of delaying or otherwise denying admission to a project or unit
based on the race, color, ethnic origin, gender, religion, disability,
or age of any member of an applicant family.

c. HUD must approve residency preferences prior to use by the
owner. HUD will approve residency preferences only if the
preference does not result in discrimination or violate equal
opportunity requirements.

d. When an owner adopts residency preferences, HUD requires that
the owner consider the following as residents:
(1) Applicants who work in the jurisdiction;
(2) Applicants who have been hired to work in the
jurisdiction; or
(3) Applicants who are expected to live in the jurisdiction as a
result of planned employment.

NOTE: “Planned employment” means bona fide offer to
work in a municipality.

e. The owner may treat graduates of, or active participants in,
education and training programs located in a residency preference
area as residents of the area if the education or training program
is designed to prepare individuals for the job market.

f. For Section 8 properties, an owner’s residency preference must
be approved by HUD through a modification to the Affirmative Fair
Housing Marketing Plan, in accordance with 24 CFR 108.25.

g. Owners may not base a residency preference on the length of
time an applicant has lived or worked in the area.

h. If there are no eligible residents on the waiting list, owners cannot
hold units open because of a residency preference. In this
situation, owners must admit the next household on the waiting
list.


Telling people they are ineligible to apply because they do not reside in the jurisdiction is a CLEAR violation of HUD Rules and Regs. And it just so happens, how they have it set up, you cant apply unless you get an application from them. So yeah, they are going to lose, racial discrimination or not, because its still going to be a fair housing violation.

See what happens in California if a affluent town wants to keep section 8 housing developments out is that they use/abuse the environmental laws and file countless lawsuits based on environmental impact claims.

Sucks for them I guess.
