much higher level at that. Mame, for example, thrived for years giving away ROMs for arcade machines that were out of production(and probably out of stock) for years. While they recently suffered a blow from a semi-related incident(they were giving away something "too new" per say), the general concensus is still that with arcade machine makers, they don't particually care for most but the absolute newest machines; and for console makers, there doesn't seem to be much of an issue with 16bit and less systems. That doesn't change the illegality, but it's more or less where things stand on when someone actually starts to care.
