I have prime95 and my 4770k is running pretty hot. When I saw hot I mean hot with temperature spike to 90C and then hovers around 65-70c with Noctua U9B under stock speed. While running Prime95 my 4770k tops out at 3.7 ghz with all 4 cores.

I could be the case that I got dud CPU not maybe I don't. Not really sure since I don't know if this is normal for everyone else.

And if I do have a dud cpu, is it possible for my cpu is fry or be damaged under stock speed, ever?

90C as such is not an issue. At stock speed as you run the tjmax is 100C and garanteed for its entire lifespan. (It throttles at 100C).

And 65-70C under prime95 is relatively cold.

Those temps seem perfectly fine to me. I believe TJmax on those CPU's is about 100*C, so 90*C for short periods of time has nearly 0 detrimental effects.
