I got this cam and the shrinkwrap license expressly prohibits use of the camera "for sexual purposes".

So don't get this cam if you have such intentions, it would be against the EULA.

so what if you do? Do you go to jail or something? Just because the EULA (i'm guessing that's end user license agreement) says you're not suppose to, does that mean you really can't?

Yes, EULA means End User License Agreement. By opening the camera shrinkwrap you automatically agree to it. Without even getting to read it first, which is kind of strange. But I am no lawyer so who am I to say.

These things have been pretty common with software for the past decade or so. Just now they have started showing up with hardware also. I-Openers boxes are taped with shrinkwrap licensed tape, and CueCat scanners come in shrinkwrap licensed packages. I am not very sure about this, it is very interesting though.

If I were you, I would not use the camera for sexual purposes. I am not sure what the consequences would be.

x10 gets such a bad rap for their so-called &quot;naughty&quot; banner ads for their spy cams.

These ads are not &quot;naughty&quot; at all. They simply feature the faces of (pretty) female models which, x10.com has figured out, results in more interest and more clickthroughs. There is no sexual text or even sexual suggestin in these ads. Just pretty models, and not even naked models. Just their faces. I think their ads are decent compared to a lot of the filth out there.

I do not know, however, if there is a prohibition against use for sexual purposes in x10.com shrinkwrap licenses. I have not purchased a cam from these guys.

Alright, time for a long spiel from a junior poster, long time reader.
I have heard lots about these EULA. Trying to force us to use software as intended, and so forth. However, a friend and I were talking about the EULAs, and the legal implications. According to him, a EULA has never been challenged in court, and software makers, and anyone else who uses them is scared sh*tless if they ever get challenged in court. The legitamacy of a EULA is questionable for many reasons. First of all, take the I-opener for example &quot;By opening the box, you must pay for x months of service, or be fined 500 dollars.&quot; However, what if you get it as an open box? What if you slice the box and give it away? Since when what we buy subject to laws of how to use. I am wondering if any of our Anandtech Legalalese know anything more on this issue. It would be nice to see if anyone had any information on a EULA being challenged. I doubt it has ever happened. But I believe it would be the end of them :)
