I don't think the school should have the right to go through the phone looking for pictures. thats just bullshit.

My wifes sister lives with us (17) i have told her if she gets in trouble with her phone at school she is fucked. she is going to be paying the phone bill until the end of the school year and no phone. If they want to take it pop out the battery, sim card and hand it over. if they demand the battery and card refuse and wait for police. we will fight that fight latter.

they don't have a right to see what the recent activity or if pictures are on the phone at all.

Shit, those administrators prolly emailed her partially nude pictures to themselves..lol...j/k :)

hmm between this (depends on how far she fights it) and the laptop invasion case (wich there is a 2nd one sueing over it now) i think students might get more rights this year..

School violated her rights and performed, what is essentially, an illegal search and seizure. They had no warrant to look through the personal data of the student.

Well, you misquoted me, but I do somwhat agree with that statment. This is a highschool kid we're talking about and she is in school to learn her readin, writing, and arithmetic, not to pass along naked pictures. She can pursue that activity after school all she wants for all I care.

I guess if the school officials want to crack down on cell phone use during school they should just start expelling each kid they catch and let the good suffer with the bad. Now that I AM against.

Taking naked pictures of yourself being illegal for your own personal use/reasons/whatever because you are a minor is such bullshit. That is none of the government's business. I don't see how such laws can exist.

Our elected officials abandoned any concept of a free people long ago. They define their right to treat you as their property via social contract.

What difference does it make what they are doing on their phones? If they are using phones for any purpose during class, they are being disruptive, and the phone should be confiscated. But why should the school be searching the contents of the phone? Does it matter if the student was sending nude pictures, clothed pictures, or texting?

I think it does. There are varying degrees of crimes. SHould all killers get the death penalty no matter what the circumstances??

I probably would of just kick the shit out of the administrator that went through my phone, but her way seems more efficient and much less of a hassle int he long run.

??? please tell me where you got your inside scoop that she was distributing those pics in school.

i bet you 1 million bucks she took those pics after school.

i bet you have some picture on your cell phone and i don't mean a naughty one just a pic say of your cat. based on your argument you shouldn't have your cell phone at work, you are there to work, you can pursue that activity after work all you want for all i care.

And, I truly believe that if it was confiscated because it was being used, the school has the right to see what the recent activity was on the cell phone.

For what purpose? If the act of using the phone is what's against the rules, then what activity it was used for doesn't matter, only that it was used. In this specific case, the article says it was confiscated because she made a phone call, so there is absolutely zero reason to be looking at pics stored on it.

Child pornography laws were intended to be used against adults who abuse children not the children themselves just as wiretapping laws were intended to protect people from unlawful eavesdropping not to protect police in public places from being videotaped.

This Judge Dredd mentality were "The Law is the Law" doesn't create a better society but rather one that creates mistrust and difficulties between the public and the police/prosecutors and in the end undermines justice itself.

She was later called to Principal Gregory Ellsworth's office, suspended for three days and told that her cell phone had been turned over to authorities after Ellsworth found semi-nude and nude photos inside, the lawsuit says.

I wish they'd charge the Principal with viewing child porn.

IMO, school has no right to invade privacy.

If he appointed people who do stupid shit, then its valid.

I agree people love to blame any past or current president for an absurd number of things, but its pretty ridiculous to never admit he might have something to do with it.

Are you going to refrain from blaming Obama when his court appointees do something you don't like?
