Seeing as how the guy was tripping on meth I'd say you'd be alright, assuming you didn't go the extra mile and kill him. Even if he wasn't on drugs it'd be self-defense as long as you don't go overboard in fighting back.

But now, my question is, if this kid were to start banging in the car with the shovel, and i knocked him out, who would be at fault, we were just on our way out, and were assaulted.

and I realize I have no idea.

I was just at a friends house, with my best friend. (we will call him toby) TOby got into a car accident a few months ago and is on probation for a class III DUI. Hes a pretty good guy, since hes on probation he stays away from partys and situations that could get him into trouble.

Well we all stopped by this friends house, and we were about to leave, i was opening the front passenger door and 'toby' was in the right rear, this guy comes up with a small shovel behind his back. I looked and thought he was messing around, and he started opening the door, i pulled his hand away, and i said "Hey whats going on, 'toby's' cool, hes on probation and haqs no problems with anyone here" this kid , (who was obviously tweeked out on meth) pushed me away and said," no its not cool".

I push em away jump over the hood and into the drivers seat, the other passengers jump in and we book. On the way home I ask what the problem is between the two. "toby" says that his best freind "mark" got into a fight with him about four months ago and messed him up pretty badly. NOw this rnadom meth induced moron thinks for some reason my friend is in on this 'conspiracy' against him (remember hes tweeking on meth). And thats the end of my story.

But now, my question is, if this kid were to start banging in the car with the shovel, and i knocked him out, who would be at fault, we were just on our way out, and were assaulted.

Toby is a moron and got caught for a DUI.
Toby also got into a fight with some guy named mark.
Someone on meth decided Toby was a meanie, and came after him with a shovel.
Who would get in trouble if Munchies put down the bong and kicked the crap out of some idiot with a shovel?

1. Somoene hit toby and there was weed in his girlfriends purse.

You didn't make the weed thing clear, so the moron comment is possibly incorrect (not enough evidence ).

2.No. TOby and mark are best friends, mark beat the snot out of the meth user.

Again, wasn't clear in the original post.
