I was just at a friends house, with my best friend. (we will call him toby) TOby got into a car accident a few months ago and is on probation for a class III DUI. Hes a pretty good guy, since hes on probation he stays away from partys and situations that could get him into trouble.
Well we all stopped by this friends house, and we were about to leave, i was opening the front passenger door and 'toby' was in the right rear, this guy comes up with a small shovel behind his back. I looked and thought he was messing around, and he started opening the door, i pulled his hand away, and i said "Hey whats going on, 'toby's' cool, hes on probation and haqs no problems with anyone here" this kid , (who was obviously tweeked out on meth) pushed me away and said," no its not cool".
I push em away jump over the hood and into the drivers seat, the other passengers jump in and we book. On the way home I ask what the problem is between the two. "toby" says that his best freind "mark" got into a fight with him about four months ago and messed him up pretty badly. NOw this rnadom meth induced moron thinks for some reason my friend is in on this 'conspiracy' against him (remember hes tweeking on meth). And thats the end of my story.
But now, my question is, if this kid were to start banging in the car with the shovel, and i knocked him out, who would be at fault, we were just on our way out, and were assaulted.

Toby is a moron and got caught for a DUI.
Toby also got into a fight with some guy named mark.
Someone on meth decided Toby was a meanie, and came after him with a shovel.
