I have decided to return the card back to the place of purchase and will soon get a replacement.
In the meantime I am using my nVidia 8800GTS 512MB.
I have really given the card a workout by playing Crysis with all video settings...

I too had a feeling that it might have been related to a heat issue.
Yes my card does run hot (approx 60 idle, 85 load) but I have had other users also achieving those temps and have not had a problem.
Also I have seen that it is not only GTX295 users experiencing the issue...

I'm experiencing a issue with not being able to run my Corsair Dominator's PC8500 at the full rated speed of 1066Mhz via BIOS.
With everything set to default it still auto detects at 800Mhz.
I'm using an Asus Striker II Formula motherboard and currently using the latest BIOS...
I used to own a Q6600 running all at default speed/voltages using the standard HSF and I was hitting approx 50/55 at idle reading from the BIOS.
I upgrade my HSF to the Zalman 9700NT and my temps dropped down to approx 30/35 so I got a major improvement just be investing in a decent HSF...
I have rolled back my BIOS rev to 1001 and I am no longer experiencing the issue therefore must be some sort of an issue with the new BIOS rev 1101

I always use the BIOS when it comes to measuring CPU temps.
This morning I checked the idle temp and found that it was sitting on 35, which ain't bad.
I just assumed that less voltage, would mean lower temps but I was wrong but it's OK.
