This doesn't mean all that much though, a lot of the time companies whose patents are invalidated are allowed to make changes to the wording that would again make the patents valid, so these tentative declarations don't mean much.
Unless you get the old intel CPUs for essentially free it makes no sense to perform any of these upgrades. I'd just wait for one of those $100 or less AMD combos to roll around if you don't mind not being on the cutting edge or just save up and get a 3570K combo if you have a microcenter...
My best guess is that they're trying to avoid having to dump the CPUs super cheaply because that would dilute what value they have left in their chips-if people get too used to paying $30 for AMD cpus they won't be able to charge more when they want to later on.

As for the actual competition maybe we should split it up a little since the fastest system at one benchmark (i.e. cinebench) might not be the fastest in another. Cinebench is obviously always going to be won by a 6 core sandy over a highly clocked ivy or something.
