I ended up sorting this out by playing with the board over the weekend. Just as Peter said, XP ignores the HPET setting. I set it to 64 bit mode and it works fine with dual booting Vista 64 bit and XP 32 bit.
My build with this board has gone fine except for one huge issue. I could not increase the FSB (not even 1 MHz) without the infamous double boot which reset the OC settings. This looks like the same issue that has occured with the P35 DS3L as described in this thread...

I have a Gigabyte GA-EX38-DS4 motherboard that I'm setting up to dual boot with XP Pro 32bit and Vista Ultimate 64bit.
How should I configure the HPET mode?
On or Off?
32bit or 64bit mode?
I know that XP does not use HPET, so does it just ignore the setting?
