Someone on the Crucial forums got a huge loss of performance after the update. Not sure if it's a common occurrence.

And nobody is arguing that Ivy Bridge uses less power at stock, but the problem is heat when scaling up, which you can't infer from stock performance.
I fail to see a catch-22.
If it was a catch-22, it'd be something like:
You can't install Nero correctly.
You must install the patch to install Nero correctly.
To install the patch you must have Nero installed correctly.
You can't install Nero correctly because you don't have the patch...
