Default Can waiters work more than 40 hrs a week?

Since they get paid crap hourly anyway, do waiters still get overtime for over 40 hours?

I imagine they would... it's the law. Wouldn't make much of a difference though, since they only get paid a few bucks an hour. So they get an extra dollar or two an hour... most of their income is tips.

They may get low hourly pay but they blew my check away on what they made on tips when i was in the restaurant biz.

Reason I ask is I wanna work 80hrs as a server, but most employers that pay a standard wage never let you go into overtime. Do restauraunts?

They do if they need you to. Otherwise, no.

why not just get two jobs then? You could work days at one place and nights elsewhere.

if you worked 7 days a week thast a little more then 11 hours per day... no restaurant is ever going to employ a waiter to work double shifts 7 days a week unless its a small mom and pop store

Probably depend on the restaurant. Ask the one you want to work at.

Server wage per hour $2.13 + tips
Overtime wage per hour $3.20 + tips

Would only cost the restaurant an extra $42.80 a week to let you work a extra 40 hours. Sounds like a good idea to let someone work double if they were a hard worker.

Well, most resturants that open for lunch at 11AM require the server to start at around 10AM. Some restaurants are open til 2AM and the servers get out around 4AM. Thats 16 hours in 1 day. 16x5=80. Thats 5 double shifts.

If you work 80 hours a week waiting tables, that will round you up in good shape. Thats 80 hours a week of walking and lifting.

Believe it or not, even most restaurants don't want you to work overtime. Granted it isn't a huge cost, but why would they pay you overtime when they can pay another person 2.13 to work instead?

And in California, servers get 6.75 plus tips.

Have you tried to rent or buy a house in California?

I rent a 2 bedroom apartment and I got a really good deal at 1200 a month, to buy anything in my area is 500,000 and up.

Yes you can, but not all restaurants would let you. At my restaurant, they don't care about overtime, but nobody wants to work 80 hours per week either. If you're consistently there more than 40 hours per week, our boss actually respects you for your hard work and happily pays the OT, since that kind of hard work is the very thing that led to him being able to buy the restaurant in the first place. I'd say most of the employees work about 25-55 hours per week, with the median being under 40. (Averaging 32 or more hours per week is all it takes to receive FT benefits.)

If you're thinking about a corporate-chain type restaurant, then yeah, the suits at the home office might frown on overtime, because they just look at every employee as a cost, instead of as an asset that actually brings in money.

It just depends on the place.

If they are in the WUI (Waiters Union International) they get double time for anything over 40.

Say what? 6.75/hr wouldn't even get you a studio apartment some places in Cali.

Minimum Wage in Oregon is 7.05.

And that's still pocket change when you realize that to gross 50k/year, you need to be making over 25$/hr.
